1. UVSC hereby issues to Subscriber a license to utilize UVSCNet Internet Services and Internet pursuant to the terms hereof. All provisions of the Terms of Service apply to all Subscriber accounts. Each Subscriber is responsible for the use of his or her account(s) and for ensuring full compliance by the user of that account with these Terms of Service.

2. Subscriber is responsible for obtaining and maintaining all equipment necessary to connect to UVSCNet Internet Services. Subscriber agrees to use UVSCNet Internet Services in a manner consistent with any and all applicable laws and regulations of the United States and applicable State laws of foreign countries.

3. UVSCNet reserves the right to change fees, surcharges, subscriber fees or institute new fees at any time upon thirty (30) days prior written notice after the initial term of service.

4. UVSCNet has the right to suspend access to UVSC Internet Services for Subscriber's account(s) immediately, without notice, upon non-payment by Subscriber, upon any breach of the terms hereof by Subscriber, or for any other reason within the sole discretion of UVSCNet.

5. A Subscriber's access to and use of UVSCNet Internete Services may be terminated at any time, and without cause, by the Subscriber or UVSCNet, by sending notice to the other party. Subscriber is liable for any charges incurred until the effective date of such termination. Terminations by subscriber will be effective on the day that UVSCNet receives written notice or on a future date if so specified in the notice.

6. Subscriber is responsible for implementing sufficient procedures and checkpoints to satisfy his/her particular requirements for accuracy of data input and output, and for maintaining a means external to UVSCNet for the reconstruction of any lost data.

7. Subscriber understands and agrees that opinions, advice, services and all other information expressed by Subscribers, information providers, service providers, or other third parties on UVSCNet Internet Services or the Internet are those of the provider and not of UVSCNet.

8. Subscriber specifically agrees not to upload, download or reproduce in any way any materials protected by copyright without the permission of the copyright owner.

9. Subscriber specifically agrees to indemnify UVSC and hold it and its agents, employees and assigns harmless for any losses, costs, or damages, including reasonable attorney's fees incurred by UVSC and relating to, or arising out of any breach of this Agreement or breach of a duty to another.

10. Only public domain files, and files in which the author has given expressed consent for on-line distribution, may be uploaded to the software libraries or other files by Subscriber. Any other software may not be uploaded to the UVSC software libraries.

11. UVSCNet at its sole discretion, reserves the right to refuse posting of files, and to remove files. UVSCNet at its sole discretion, further reserves the right to immediately terminate, without Notice, any subscriber who misuses the software libraries.

12. The license granted to Subscriber under the terms hereof allows subscriber to use the Internet and UVSCNet Internet Services when roaming. The subscription is not shareable. Each person who uses UVSCNet Internet Services must be a Subscriber in its/his/her own right. Subscriber will not allow any other person or entity to utilize UVSCNet Internet Services or the Internet through assigned account.

13. Subscriber agrees not to resell or obtain any compensation in any form, directly or indirectly, from any other person or entity for access, products, service or content through UVSCNet Internet Services without the express written permission of UVSCNet.

14. Subscriber may not distribute USERIDs and PASSWORDs to any UVSCNet Internet service or Internet to others.

15. This license shall terminate upon termination of the subscription for which it was used, or issued. Upon such termination Subscriber must either return all UVSCNet Software to UVSC or destroy it. Subscriber who desires to terminate its/his/her subscription to UVSCNet Internet Services must do so in accordance with the terms hereof. This Agreement and the license granted herein may be and shall continue in full force and effect so long as Subscriber continues to receive UVSCNet Internet Service and pays any fees due.

16. UVSC exercises no control whatsoever over the content of the information passing through UVSCNet Internet Services. However, please note that it is a violation of Utah state law for anyone to distribute, or to import for distribution, any pornographic materials. Each user of the Internet has the responsibility to ensure their own compliance with the law. It is not possible for UVSC as an Internet access provider to effectively deny access to any offensive or pornographic materials that may be posted from time to time on the Internet. Each UVSCNet Internet Service user is responsible to control the materials retrieved from the Internet. Utah Valley State College urges those who wish to limit access for minors to employ appropriate measures to exercise any needed controls.

17. UVSC makes no warranties of any kind, whether expressed or implied, for the service it is providing. UVSC also disclaims any warranty of merchantability or fitness for a particular purpose. UVSC will not be responsible for any damage suffered by Subscriber. This includes loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by its own negligence or Subscriber's errors or omissions.

18. UVSCNet Internet Services may only be used for lawful purposes. Transmission of any material in violation of any U.S. or any State's regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret laws. Subscriber agrees to indemnify and hold UVSC harmless from any claims resulting from its/his/her use of the service which damages Subscriber or other party.

19. Any access to other networks through UVSCNet Internet Services must comply with the rules appropriate for such other network(s).

20. Use of any information obtained via UVSCNet Internet Services communications service is at Subscriber's own risk. UVSC specifically denies any responsibility for the accuracy or quality of information obtained through its service.
